Terms of Service

By accessing or using the EnableNow.in platform, website, and services (collectively, the “Service”), available at https://enablenow.in, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and EnableNow.in (“we,” “us,” or “our”). By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

EnableNow.in is an artificial intelligence-powered website builder designed to help Indian Micro, Small, and Medium Enterprises (MSMEs) create, redesign, and manage professional websites. The Service enables users to:

• Generate modern website designs from an existing website URL
• Create websites from uploaded design mockups or screenshots
• Build websites from natural language descriptions of their business
• Edit, customise, and publish generated websites
• Host websites on EnableNow.in subdomains or custom domains

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

To use certain features of the Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain and promptly update your account information to keep it accurate, current, and complete
• Maintain the security and confidentiality of your login credentials and not share them with any third party
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account or any other breach of security

We reserve the right to suspend or terminate your account if any information provided during registration or thereafter proves to be inaccurate, false, or misleading, or if you violate any provision of these Terms.

Your Content. You retain all ownership rights in any content you upload, submit, or provide to the Service, including but not limited to text, images, logos, brand assets, and business information (“User Content”). By uploading User Content, you grant EnableNow.in a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

Generated Content. Websites and designs generated by the Service using artificial intelligence (“Generated Content”) are provided to you under a perpetual, non-exclusive licence. You may use, modify, and publish Generated Content for your personal or commercial purposes. EnableNow.in does not claim ownership of Generated Content created specifically for your account.

Our Intellectual Property. The Service, including its underlying technology, algorithms, software, user interface designs, templates, and documentation, is the intellectual property of EnableNow.in and is protected by applicable copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.

Third-Party Content. You represent and warrant that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party. You are solely responsible for ensuring that you have the necessary rights and permissions for any content you upload.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation
• Create websites that promote illegal activities, violence, hatred, discrimination, or harassment
• Distribute malware, spam, phishing pages, or other harmful or deceptive content
• Infringe upon the intellectual property, privacy, or other rights of any third party
• Scrape, crawl, or reproduce third-party websites without the owner's explicit consent
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Create multiple accounts to circumvent plan limitations or abuse free-tier offerings
• Resell or redistribute the Service without our prior written consent
• Use the Service in any manner that could damage, disable, or impair the Service

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing offending content, suspending or terminating the violator's account, and reporting such activity to law enforcement authorities.

Pricing. The Service offers both free and paid subscription plans. All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Current pricing details are available on our website.

Payment Processing. Payments are processed securely through Razorpay, a PCI DSS-compliant payment gateway. By making a payment, you also agree to Razorpay's terms of service. We do not store your complete payment card details on our servers.

Billing Cycle. Subscription fees are billed on a recurring monthly or annual basis, depending on the plan selected. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.

Refund Policy. If you are not satisfied with the Service, you may request a refund within 7 days of your initial subscription purchase. Refunds are issued at our discretion and are processed to the original payment method. Refunds are not available for renewal payments, partial billing periods, or if your account has been terminated for violation of these Terms. Price Changes. We reserve the right to change our pricing at any time. If we change the pricing for your current plan, we will provide you with at least 30 days' advance notice before the new pricing takes effect. Your continued use of the Service after the price change constitutes your agreement to the new pricing.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will endeavour to provide advance notice)
• Emergency maintenance or security patches
• Circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, or third-party service failures

For published websites hosted on the EnableNow.in platform, we target 99.9% uptime on a monthly basis for paid plans. This target is not a guarantee and does not give rise to any right to a refund or credit unless explicitly stated in a separate service-level agreement.

To the maximum extent permitted by applicable law, EnableNow.in, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of or inability to use the Service.

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to EnableNow.in in the twelve (12) months immediately preceding the event giving rise to the claim, or One Thousand Indian Rupees (INR 1,000), whichever is greater.

The Service, including all Generated Content, is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the AI-generated websites will be error-free, meet your specific requirements, or achieve any particular results.

By You. You may terminate your account at any time by contacting us at support@enablenow.in or through your account settings. Upon termination, your right to use the Service will immediately cease.

By Us. We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, including but not limited to if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if required to do so by law.

Effect of Termination. Upon termination, all published websites associated with your account will be taken offline within 30 days. We will make commercially reasonable efforts to allow you to export your content before deletion. User Content may be retained in our backups for a limited period in accordance with our data retention policies. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property provisions, limitation of liability, and governing law.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date at the top. For significant changes, we may also notify you via email or through the Service interface.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and terminate your account.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days. If the dispute cannot be resolved through negotiation, either party may pursue remedies available under applicable law.
